By accessing or using VIRad.AI ("the Service"), operated by VIRad.AI Medical LLC, a Delaware limited liability company ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.
VIRad.AI is a clinical reference tool built for interventional radiology professionals. The Service provides AI-powered clinical reference, literature search, clinical scoring calculators, procedure guides, and educational resources. All outputs are intended to supplement — never replace — the clinical judgment of qualified healthcare providers.
The AI component generates responses from its training knowledge and supplementary retrieval from medical literature. Sources are drawn from PubMed (via the public NCBI E-Utilities API) and CC-BY licensed open-access content. While we strive for accuracy, AI-generated content is not guaranteed to be accurate, complete, or up-to-date.
Information is for clinical reference only. All content provided by VIRad.AI — including AI-generated responses, procedure guides, clinical scores, and literature summaries — is intended solely as a clinical reference resource. It is NOT personalized medical advice tailored to any specific patient, clinical scenario, or institutional protocol.
Independent verification required. All clinical decisions must be independently verified by the treating physician. Users are responsible for independently verifying all clinical information, drug dosages, procedural details, contraindications, and guideline recommendations before applying them in patient care. VIRad.AI outputs should never be the sole basis for any clinical decision.
AI responses are generated from the model's training knowledge and supplemented with citations from peer-reviewed medical literature retrieved from PubMed (via the NCBI public API) and CC-BY licensed open-access content. All cited sources are verified to exist via the National Library of Medicine's PubMed database. However, citation accuracy, completeness, and relevance are not guaranteed.
Anthropic API data policy. VIRad.AI uses the Anthropic API for AI processing. Per Anthropic's API Terms of Service, API inputs and outputs are not used to train Anthropic's models. Query data sent to Anthropic is deleted after processing in accordance with their data retention policy.
AI-generated content may not reflect the most current evidence. Medical literature is continuously evolving, and there may be a delay between publication of new evidence and its availability in our system. Users should always verify recommendations against current guidelines and primary sources.
The Services are designed for use by licensed healthcare professionals and are not intended for use by children under the age of 18. By creating an account, you represent that you are at least 18 years old, that you are a licensed healthcare professional, medical trainee, or researcher, and that you will use the Service in accordance with these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use.
VIRad.AI offers a free tier with limited access. Paid subscription tiers with additional features are planned and will be available in the future. Specific pricing and feature details will be published within the application and are subject to change.
Paid subscriptions are processed by a PCI-compliant third-party payment processor. By subscribing, you agree to pay all applicable fees. Subscriptions renew automatically unless cancelled before the renewal date. Refund policies are detailed at the time of purchase.
VIRad.AI does not enter into Business Associate Agreements (BAAs) and is not designed to comply with HIPAA Privacy, Security, or Breach Notification Rules. If you are subject to HIPAA or similar data protection regulations, it is your sole responsibility to ensure compliance. VIRad.AI disclaims all liability for any PHI entered by users in violation of this policy.
Users who require HIPAA-compliant clinical tools should use their institution's approved electronic health record (EHR) systems and clinical decision support tools that maintain BAAs.

All content, software, algorithms, user interfaces, trademarks, and other intellectual property associated with VIRad.AI are owned by or licensed to VIRad.AI. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your active subscription.
AI-generated responses may incorporate information from publicly available medical literature and guidelines. Such content retains the intellectual property rights of its original authors and publishers. VIRad.AI does not claim ownership over source materials cited in its outputs.
VIRad.AI respects the intellectual property rights of others. If you believe that any content available through the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing the following information in writing to our designated copyright agent:

Articles, images, and reference materials displayed within the Service are sourced from open-access repositories published under Creative Commons licenses (CC-BY, CC0) or U.S. Government public domain licenses. VIRad.AI does not claim ownership of third-party content and provides attribution where applicable.
Citations and source cards displayed in the Service link to publicly available resources (PubMed, PMC, DOI links). VIRad.AI does not host copyrighted full-text articles. The accuracy, completeness, and continued availability of third-party content is not guaranteed by VIRad.AI.
User data is retained per Supabase hosting policies and is not sold to third parties. User account data, preferences, and usage history are stored securely with encryption at rest. For details on how we handle your data, please see our Privacy Policy.
Query log retention. Anonymized query logs and usage data may be retained for up to seven (7) years for purposes of liability defense, quality improvement, service analytics, and compliance with legal obligations. Query logs do not contain patient-identifying information (users are prohibited from entering PHI as described in Section 8).
Pseudonymization upon account deletion. Upon account deletion, clinical query logs are pseudonymized (all personally identifying information replaced with an irreversible code) and retained for up to 7 years solely for quality assurance, safety monitoring, and defense of legal claims, as permitted under GDPR Article 17(3)(d), CCPA §1798.105(d)(8), and applicable medical record retention laws.
No liability for patient outcomes. VIRad.AI is not liable for any patient outcomes, adverse events, clinical complications, malpractice claims, or any other consequences resulting from a healthcare provider's use of or reliance on information provided by the Service. The Service is a supplementary reference tool, and all clinical decisions remain the sole responsibility of the treating healthcare professional.
Any claims arising in connection with your use of the Services must be brought within one (1) year of the date of the event giving rise to such action. Any claim not brought within this period is permanently barred. This limitation applies to the fullest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless VIRad.AI and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:
No guarantee of uptime. VIRad.AI is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or continuously available access to the Service. The Service may experience downtime due to maintenance, updates, server issues, third-party service disruptions, or other factors beyond our control.
VIRad.AI shall not be liable for any damages or losses resulting from service interruptions, temporary unavailability, or degraded performance. Users should not rely on VIRad.AI as their sole clinical reference resource for time-sensitive or emergency clinical decisions.
VIRad.AI reserves the right to modify, update, suspend, or discontinue any feature, functionality, or component of the Service at any time, with or without notice, and without liability to you. This includes changes to AI models, clinical content, scoring calculators, subscription tiers, pricing, and any other aspect of the platform.
Continued use of the Service after modifications constitutes acceptance of the updated Service. If you do not agree with material changes, your sole remedy is to discontinue use of the Service.
Termination by VIRad.AI. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms, misuse of the Service, or entering PHI into the platform.
Termination by you. You may terminate your account at any time by contacting us at support@virad.ai or through the account settings within the application. Upon termination, your right to use the Service ceases immediately.
Effect of termination. Upon termination, your personal data will be deleted within 30 days, subject to the pseudonymized retention described in Section 14. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and dispute resolution — shall continue in effect.
The Services are designed for use by licensed healthcare professionals and are not intended for use by children under the age of 18. We do not knowingly collect personal information from individuals under 18. If we learn that we have collected data from a minor, we will delete it promptly.

VIRad.AI is initially US-focused but global users may sign up and use the Service. If you access the Services from outside the United States, you consent to the transfer and processing of your information in the United States. These Terms shall be governed by the laws of the State of Delaware, United States. VIRad.AI makes no representation that the Service is appropriate or available for use in all locations outside the United States, and compliance with local laws is the responsibility of the user.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Binding arbitration. Any dispute arising from these Terms shall be resolved through binding arbitration in Wilmington, Delaware, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or other representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to update these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and VIRad.AI regarding your use of the Service and supersede all prior agreements, understandings, and communications.
